1. Who we are
Suvax (the "Service") is operated by Ferdinand Hemptenmacher ("we", "us", "our"). By accessing or using the Service, you ("you", "user") agree to be bound by these Terms & Conditions.
2. Acceptance
By continuing to use the Service you confirm that you accept these Terms and that you have the authority and legal capacity to enter into this agreement.
3. The Service
Suvax helps users discover TikTok creators relevant to their product. Suggestions are generated from publicly available data and are provided on an "as is" basis. We do not guarantee uninterrupted or error-free operation.
4. Acceptable use
You agree not to misuse the Service. In particular you must not: (a) use it for any unlawful purpose, (b) engage in fraud or spam, (c) infringe any third-party intellectual property rights, (d) interfere with the security or integrity of the Service (including malware, probing, or scraping), or (e) attempt to reverse engineer or circumvent any technical limits.
5. Account and credentials
You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. You agree to provide accurate information and to keep it up to date.
6. Intellectual property
We retain all rights, title and interest in the Service, including its software, documentation and branding. Subject to these Terms, you are granted a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes.
7. Payment, subscriptions and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms. Subscriptions renew automatically until cancelled. See our Refund Policy for refund details.
8. Suspension and termination
We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations.
9. Disclaimers and liability
To the fullest extent permitted by law, we disclaim all implied warranties including merchantability and fitness for a particular purpose. Our aggregate liability is capped at the fees you paid us in the twelve (12) months preceding the claim. We exclude liability for indirect, consequential or special damages.
10. Changes
We may update these Terms from time to time. Material changes will be announced in the Service. Continued use after changes take effect constitutes acceptance.
11. Governing law
These Terms are governed by the laws of the seller's jurisdiction of residence, without regard to its conflict-of-laws principles.
